Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, software, and services provided by RacquetDesk, LLC (“RacquetDesk,” “we,” “us,” or “our”), including racquetdesk.com, racquetdesk.net, 10sportal.com, and 10sportal.net (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services on behalf of a club, facility, business, or other organization, you represent that you are authorized to do so.

Our Services

RacquetDesk provides software for racquet and paddle sports facilities, including scheduling, reservations, member and account management, payments, communications, and related facility-management functions.

We may add, modify, or discontinue features of the Services from time to time.

Accounts and Acceptable Use

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You may not use the Services to violate applicable law, gain unauthorized access to systems or accounts, distribute malicious software, interfere with the operation of the Services, reverse engineer the Services except where permitted by law, or otherwise use the Services in an unauthorized manner.

Customer Data

You or the applicable RacquetDesk customer retain ownership of data submitted to the Services. You authorize RacquetDesk to host, process, transmit, and otherwise use that data as reasonably necessary to provide, maintain, secure, and support the Services.

Third-Party Services and Integrations

RacquetDesk may integrate with third-party products and services. Your use of those services may also be subject to the applicable third party’s terms and privacy policies.

If you choose to connect a Google account, including Google Calendar, you authorize RacquetDesk to access and process the Google account information necessary to provide the requested integration. RacquetDesk’s use and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including its Limited Use requirements.

You may disconnect your Google account from RacquetDesk at any time.

Intellectual Property

RacquetDesk and its licensors retain all rights, title, and interest in the Services, including the software, designs, trademarks, logos, documentation, and related intellectual property.

Your use of RacquetDesk does not transfer ownership of any RacquetDesk intellectual property to you.

Availability and Disclaimer

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, RacquetDesk disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will always be uninterrupted, error-free, or available.

Limitation of Liability

To the maximum extent permitted by law, RacquetDesk and its officers, employees, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill arising from your use of the Services.

Any additional limitations applicable to RacquetDesk customers are governed by their Services Agreement or other written agreement with RacquetDesk.

Suspension and Termination

We may suspend or terminate access to the Services for violations of these Terms, misuse of the Services, security concerns, or as otherwise permitted under an applicable Services Agreement.

Services Agreements

Organizations subscribing to RacquetDesk may also be subject to a Services Agreement, order form, quote, or other written agreement with RacquetDesk.

If these Terms conflict with an applicable written agreement between RacquetDesk and a customer, the written agreement will control with respect to that customer.

Changes to These Terms

We may update these Terms from time to time by posting a revised version on this website. Changes will become effective as provided in any applicable Services Agreement or as otherwise required by law. Your continued use of the Services after the applicable effective date constitutes acceptance of the updated Terms.
